1. Acceptance of Terms
By accessing and placing orders on The Fruiteria website, you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Service Area
We provide delivery services within the Greater Boston area only, up to 25 miles from our location. Orders placed outside this zone will be cancelled and refunded.
3. Orders & Pricing
All prices are listed in USD. We reserve the right to modify prices at any time. Order confirmation emails constitute our acceptance of your order. We may cancel orders if products become unavailable or if payment cannot be processed.
4. Payment
Payment is processed securely through Clover. By placing an order, you authorize us to charge the total amount to your payment method. All sales are final unless our refund policy applies.
5. Delivery & Pickup
We make every effort to fulfill orders during the selected time window, but delivery times are estimates and not guaranteed. We are not responsible for delays caused by circumstances outside our control (traffic, weather, etc.).
6. Product Freshness
We guarantee the freshness of our products at the time of delivery or pickup. Claims must be made within 24 hours of receipt with photographic evidence. Our liability is limited to replacement or store credit.
7. Cancellations & Refunds
Orders may be cancelled before preparation begins. Once an order is being prepared, cancellations may not be possible. Refunds for quality issues are issued as store credit or to the original payment method within 5-7 business days.
8. Allergies & Dietary Restrictions
It is the customer's responsibility to review ingredient and allergen information. We cannot guarantee that our products are free from all allergens. If you have severe allergies, please contact us before ordering.
9. Intellectual Property
All content on this website, including text, images, and branding, is the property of The Fruiteria and may not be used without written permission.
10. Limitation of Liability
To the fullest extent permitted by law, The Fruiteria shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services.
11. Governing Law
These terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes shall be resolved in the courts of Massachusetts.
